Appeals Court Hearing Date Announced For Prop 8 Appeal

The 9th US Circuit Court of Appeals has announced that it will hear oral arguments regarding Proposition 8 on Monday, December 6 starting at 10:00 AM.

The court will be considering at least two issues:
- Do the proponents of Proposition 8, and the County of Imperial among others, have standing to be heard in the appeals court?
- Did Judge Vaughn Walker err when he decided that Proposition 8 is void because it violates the US constitution?

The hearing will be held at The James R. Browning US Court House 95 7th St. in San Francisco California.

October 18 was the deadline for all groups supporting Judge Walker’s decision (overturning Proposition 8) to submit briefs in support of the Judge’s decision, and about 30 groups have submitted briefs.

These include a diverse group of supporters of marriage equality from within the LGBTI community, such as; Equality California, National Center For Lesbian Rights, National Gay and Lesbian Task Force, and Lambda Legal among others.

However many advocacy groups from outside the LGBTI community submitted briefs as well, such as the NAACP, a coalition of Asian and Pacific Islander Groups, several religious institutions, etc.

Other states, and state legislators also submitted briefs in opposition to Proposition 8, as did many law groups and organizations in the health professions.
